Your legal position regarding driving without a legal ITV affects 2 areas. The first area is the legal position regarding the police stopping you and the second is regarding your insurance. The information below is given via meetings and conversations with Guardia Civil, ITV office and Insurance underwriters in Mallorca.
It is illegal to drive without a valid ITV unless driving either to an ITV appointment or to a garage with an appointment. If you are stopped by the police they can issue a fine. It is as simple as that. Fines currently vary betwen 200€ and 500€. Anecdotally and particularly since the enourmous ITV backlog following covid the following applies:
Insurance companies are legally obliged to maintain third party cover when a car does not have a valid ITV. However to quote the insurance underwriter directly:
" If an ITV certificate has recently expired and they are awaiting a new date, and providing the vehicle is roadworthy, then the insurance cover is still in place however in the event of a claim, this may be taken into account regarding any settlement that may be offered." "
Whilst there are many insurance companies and we have not spoken to all underwriters we can confidently say this is a universal position.
The attempt to reclaim any 3rd party payments or to offer a reduced settlement are purely dependent on the insurance company deciding that the roadworthiness of the vehicle can be shown to be a contributing factor in the claim. If you drive into the back of another car for example and the question of the condition of your brakes is raised then without a valid ITV showing when they were last inspected the insurance company could have a legal case for reducing it's settlement offer or even requiring that you re-imburse them for 3rd party claims.
Many people are suprised to learn this. If you do not believe this then please talk to your local guardia civil office and your insurance underwriters and let us know if you find out any contradicting information.
